Personal Injury Doctrine in Nevada

Personal injury cases fall under a category of law referred to as tort law. Essentially, the purpose of tort law is to allow for a plaintiff to be compensated for damages that occurred as a result of the behavior of another; in a personal injury suit, the defendant may take the form of a company, an insurance provider, or an individual person. As you might suspect, the exact rules and regulations are different between states, but Nevada adheres to a fault statute known as “modified comparative negligence.”

What this means is that fault may be attributed to all parties involved, not just 100 percent assigned to one person and none to another. In Nevada, one or more defendants in a personal injury suit must be deemed to be at least 50 percent liable for the plaintiff’s injuries in order for the plaintiff to recover compensation. If the plaintiff is the one who is deemed over 50 percent, he or she is barred from receiving any restitution. So, in other words, you can still recover money if you were partly to blame, but not if you were the main cause.

Types of Damages a Personal Injury Law Firm Can Recover

Personal injury claims are considered civil proceedings, therefore the goal is obtain a monetary settlement, not to convict somebody of a criminal offense. It may not seem possible to wrap up all the physical and psychological damages into a settlement figure, but cases are settled every day, which is why it is imperative that accident victims seek the help of a trusted personal injury law firm.

Each case is different, which means that the settlement figures will change depending on the severity of the plaintiff’s injuries, the extent of the defendant’s negligence or malpractice, and the parameters of the accident itself. Compensation will usually come in the form of compensatory damages, at Van Law Firm, we commonly recover the following for our clients:

  • Medical costs
  • Property damage
  • Lost wages, damage to future earnings
  • Disability
  • Loss of enjoyment
  • Pain and suffering
  • Loss of companionship

Punitive damages are also occasionally awarded in personal injury cases, for especially brutal or heinous behavior. They are additional fines that are heavy-handed in nature, in order to deter such acts from happening again. Courts generally award punitive damages if a defendant has either harmed multiple people or acted wrongfully for a long period of time.

As the most trusted personal injury law firm in Las Vegas, we can handle the scope and complexity of any case. We have decades of experience working with opposing counsel and insurance companies, and almost all of our attorneys come from an insurance defense background, so they truly know the system inside and out.
