Personal Injury Doctrine in Nevada
Personal injury cases fall under a category of law referred to as tort law. Essentially, the purpose of tort law is to allow for a plaintiff to be compensated for damages that occurred as a result of the behavior of another; in a personal injury suit, the defendant may take the form of a company, an insurance provider, or an individual person. As you might suspect, the exact rules and regulations are different between states, but Nevada adheres to a fault statute known as “modified comparative negligence.”
What this means is that fault may be attributed to all parties involved, not just 100 percent assigned to one person and none to another. In Nevada, one or more defendants in a personal injury suit must be deemed to be at least 50 percent liable for the plaintiff’s injuries in order for the plaintiff to recover compensation. If the plaintiff is the one who is deemed over 50 percent, he or she is barred from receiving any restitution. So, in other words, you can still recover money if you were partly to blame, but not if you were the main cause.
