What is the average payout for a Zantac claim?

As of the date of this post, no Zantac lawsuits have been paid out. The lawsuits are still on-going and are not expected to start paying out for 2-3 years. Because of this, it is difficult to give an exact number for what the Zantac lawsuit payouts will be. However, we can look to similar cases to predict what the payout may be once the lawsuits have been decided and the claims are settled.

It is important to note that any payout is affected by several factors. Every case is unique and each case may include one or more of these deciding factors.

Some of these factors are:

• The extent of the injuries. For example, a person suffering from a later stage of cancer could get a higher payout than someone whose illness was found earlier.
• The number of injuries. For example, having more than one type of cancer could lead to a higher payout than those claimants with one type only.
• The strength of the evidence. For example, someone who has kept medical records regarding the cancer and its treatments or when they started and stopped taking the drug will be able to better prove the claim and can lead to a higher payout than someone without records.

The combination of factors will put an injured party into one of three tiers with those in the upper tiers receiving higher pay-outs.

  It is important to keep in mind that the Actos payout has no bearing on what Zantac’s average payout will be. But it is a good comparison to give a possible general idea.

• Roundup:Roundup is a weed killing spray that was used across the United States. The Roundup lawsuits are a good comparison to the Zantac cases because both are about a consumer product that caused cancer. In the Roundup cases, claimants received anywhere from $5,000 to $250,000 with the average payout being $160,000.

Tiers:

The following tiered injury chart will give an estimate of a potential payout amount.

• Tier I:
  Those that fall under Tier I injuries will most likely receive upwards of $300,000 in payout.Someone is most likely to have a Tier I injury if they suffer from stomach, prostate, pancreatic, or breast cancer.
• Tier II:Those that fall under Tier II injuries will most likely receive between $80,000 and $160,000 in payout.

  Someone is most likely to have a Tier II Injury if they suffer from liver, bladder, or kidney cancer.

• Tier III:Those that fall under a Tier III injury will most likely receive between $20,000 and $60,000 in payout.

  Those not suffering from one of the above-listed cancers will fall into the Tier III category.

What happens after a payout?

After the payout is awarded, it will be split between the client and her lawyers. The standard legal fee for a plaintiff’s attorney in a case like Zantac is 40%.

For example, if someone has a Tier I injury that receives a payout for $300,000, then she would, most likely, receive approximately $240,000 minus any costs of the lawsuit.
